Image and risks, for a member under 18: full text
The academy takes images — photographs and video — during classes, seminars, competitions and events, and publishes some of them. The authorisation is given freely: refusing has no consequence whatsoever for the child's attendance at classes or progression.
I may withdraw this authorisation at any time, in whole or in part, by filling in this form again, without having to give reasons. The academy then stops any further publication and removes from its website the images of which the child is the subject. For posts already published on its social media accounts, as for large group photographs, a removal request is considered case by case. Withdrawal has no effect on printed copies already distributed or on copies already made by third parties. Images are used solely to present and document the activity of Kaizen BJJ Brussels; they are not sold or assigned to third parties for commercial purposes, the authorisation gives no right to any payment, and the academy undertakes not to publish anything that harms the child's dignity, reputation or private life. Separately, a portrait is taken when the child enrols so that the instructors can identify them and learn their name: that use does not depend on this authorisation and rests on the academy's legitimate interest — see points 2 and 7 of the privacy notice, kaizen-bjj.be/privacy/. If I authorise publication above, it is that same portrait that appears on the website.
Brazilian jiu-jitsu is a grappling combat sport: close and continuous physical contact with a partner, with training fights of varying intensity. As in any contact sport, a risk of injury exists and cannot be entirely eliminated. I acknowledge having been informed of this. The child practises voluntarily, and it is up to me to make sure they are fit to do so. That risk is greatly reduced by measured practice, attention to one's partner and observance of the instructors' directions: that is the purpose of the undertakings below.
The child undertakes to:
Failure to observe these rules may lead to exclusion from a class and, in the event of serious or repeated breach, to the end of the child's participation in the academy's activities.
This section is an acknowledgement of the risks inherent in the practice and an undertaking to observe the safety rules. It involves no waiver of the child's rights or of mine: under Belgian law it neither limits nor excludes the liability of the academy, its instructors or its staff in the event of intentional fault, gross negligence, or a breach causing harm to life or physical integrity.
